Rep. Barry Moore Supports Texas Reps Impeachment Against Plane-Recall Judge

Representative Brandon Gill (R-TX) has filed Articles of Impeachment against U.S. District Judge James Boasberg. Gill accused the judge of “high crimes and misdemeanors” over a recent ruling that blocked President Donald Trump’s plan to deport alleged Venezuelan gang members. Calling Boasberg a “radical activist judge,” Gill insisted he must be ousted from the bench.

Representative Barry Moore posted on X supporting the resolution:

"Proud to join @RepBrandonGill in removing activist judges who look to advance their own agendas instead of adhering to the law!"

The filing stems from Boasberg’s decision to issue a temporary restraining order preventing President Trump from flying alleged members of the Venezuelan terrorist gang Tren de Aragua out of the country. Trump had used the Alien Enemies Act of 1798 to target suspected gang members. Boasberg’s ruling ordered planes already en route to El Salvador to turn around mid-flight and return to the U.S. However, the planes continued on, landing safely in El Salvador.

The President replied on Truth Social:

“This Radical Left Lunatic of a Judge, a troublemaker and agitator who was sadly appointed by Barack Hussein Obama, was not elected President - He didn’t WIN the popular VOTE (by a lot!), he didn’t WIN ALL SEVEN SWING STATES, he didn’t WIN 2,750 to 525 Counties, HE DIDN’T WIN ANYTHING! I WON FOR MANY REASONS, IN AN OVERWHELMING MANDATE, BUT FIGHTING ILLEGAL IMMIGRATION MAY HAVE BEEN THE NUMBER ONE REASON FOR THIS HISTORIC VICTORY. I’m just doing what the VOTERS wanted me to do. This judge, like many of the Crooked Judges’ I am forced to appear before, should be IMPEACHED!!! WE DON’T WANT VICIOUS, VIOLENT, AND DEMENTED CRIMINALS, MANY OF THEM DERANGED MURDERERS, IN OUR COUNTRY. MAKE AMERICA GREAT AGAIN!!!”

The Judge’s actions and the President's response generated a firestorm of activity on social media.

In a rare comment, Chief Justice John Roberts took issue with the President's call for Boasberg’s impeachment. “For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision. The normal appellate review process exists for that purpose,” Roberts said.

Former Speaker Newt Gingrich disagreed with the Chief Justice.. “If Chief Justice Roberts wants to minimize attacks on out of control appointed leftwing district court judges abusing their role and claiming to be able to overrule the elected President of the United States on management details that are clearly within his role as defined by the Constitution and the Federalist Papers then he should intervene and overrule these absurd power grabs,” Gingrich posted on X. “The Chief Justice can defend the Court by overruling bad judges before the Executive and Legislative Branches start acting against them. The burden is on the Chief Justice not the President.”

Rep. Mike Lee supported Rep. Gill’s action. “Impeachment is a non-justiciable political question assigned by the Constitution to Congress—one of the two political branches of the U.S. government—and not to the courts. Frankly, I’m surprised that Chief Justice Roberts is publicly opining on such matters.”

Complicating matters was the report by journalist Laura Loomer that Judge Boasberg’s daughter for the 501(c)3 NGO Partners for Justice as a “capacity building associate.” Partners for Justice provides illegal aliens and gang members with legal advice, and is largely supported by U.S. grants.

This would appear to be a significant conflict of interest that Judge Boasberg did not disclose prior to making his controversial ruling.

Rep. Brandon Gill is freshman lawmaker from Texas’s 26th District. A vocal Trump supporter, Gill has drawn attention with his brash style and hardline conservative stances on border security and law-and-order policies.

Judge James Boasberg, 62, sits on the U.S. District Court for D.C. An Obama appointee, he is a Yale graduate with a Harvard law degree. Boasberg has presided over sensitive cases such as pipeline disputes and secret FISA court rulings.

Gill’s impeachment case faces steep odds. Impeachment requires a House majority to pass and a two-thirds Senate vote to remove Boasberg. Even those who support the move acknowledge getting these votes is unlikely in the current divided Congress. Nonetheless, Gill appears determined to proceed.

For now, Boasberg’s ruling stands, and the deportation plan is temporarily on hold while the White House considers their next step.
