The Residency Lawsuit Against Tommy Tuberville Is Political Lawfare, Plain and Simple

Alabama voters have already spoken. Tommy Tuberville is the Republican nominee for Governor of Alabama, and yet his opponents continue trying to accomplish through the courts what they have been unable to accomplish at the ballot box.

That is exactly why the continuing residency lawsuit against Tuberville looks less like a legitimate election dispute and more like political lawfare.

The Alabama Constitution requires a governor to have been a resident citizen of Alabama for at least seven years before the election. Tuberville has deep and longstanding ties to Alabama. He coached Auburn University for a decade, owns a home in Auburn, is registered to vote in Alabama and has represented Alabama in the United States Senate since 2021.

More importantly, the Alabama Republican Party has already considered and rejected a residency challenge against Tuberville. Then, in July, Montgomery County Circuit Judge Brooke Reid dismissed a separate lawsuit attempting to challenge his eligibility.

That should have been the end of it.

Instead, the litigation continued through an appeal to the Alabama Supreme Court. Tuberville’s attorneys have asked the state’s highest court to uphold the dismissal, arguing that Alabama law sharply limits judicial interference in election disputes of this kind.

At some point, Alabama voters should ask a much larger question: Who should decide their next governor—the people of Alabama or litigants attempting to derail a candidate through the court system?

Tuberville didn’t sneak onto the ballot. Alabama Republicans overwhelmingly selected him as their nominee. He has spent six years representing this state in Washington, casting votes and fighting for the people who sent him there.

Now those same voters deserve the opportunity to decide whether they want him serving as their governor.

Using litigation to interfere with that choice represents precisely the kind of political lawfare Americans have grown tired of watching. Elections should be decided by voters—not by an endless procession of lawsuits designed to knock political opponents out of the race.

Tommy Tuberville’s candidacy should rise or fall on his record, his policies and the judgment of Alabama voters.

If opponents believe Alabama needs a different governor, there is a perfectly legitimate way to make that argument: make their case to the people and win the election.

But stop trying to use the courthouse to accomplish what opponents couldn’t accomplish at the ballot box.

Alabama belongs to its citizens, and Alabama voters—not political operatives, lawyers or strategic lawsuits—should choose their next governor.

And the truth is, the people have already decided. Alabama Republican voters overwhelmingly chose Tommy Tuberville to be their nominee for governor. Their voices were heard, their votes were counted, and their decision should be respected.
